Bcc: Many
¡Now for the moment I will put aside the Rights and Freedoms act giving all the right to vote and to stand to qualify for office not qualify to stand or for nomination.
¡I expect city council and it's clerk's office to limit itself to the language it offers even if all people of the year of Majority are unlimited by signatures to run for office,
¡they should try and set an unconstitutional bylaw like they did for councillors with the language "Mayor" or "President of Council."
¡Maybe the charter should be written better and possibly include someone who understands systems with separate executive office from the legislative.
¡I put this to a few of you not knowing exactly who to go to about this.
¡The Clerk's Election Officers have no idea who to go to challenge these things even know one can, and even some lawyers don't know.
¡Paul Hancock of the City of Vancouver insists that if it doesn't apply based on the Mayoral definition in Part IV of the Charter then there is no
¡standard to run; well he's wrong there is still a fee; an absurd fee.
¡So fine, just ask for basic information, and intention to take office and stand for it as well as the $100 fine until there is a Bylaw for the Mayor's
¡Office Nomination Requirements. Financial Papers are a limitation and voting limitations could be used as logical limitation.
¡But the bylaw and the Charter is in plain language an it says what it says; I don't care about the opinion of any municipality, I care about what
¡it says.
¡I have doubts about impartiality of the election office in totality, at least on regarding the non-partisan run.
¡I don't want this to become class actions and Human Right complaints. Given the Rights and Freedoms document, all Candidates who didn't vote for this (non-incumbents) could complain. May want to review this charter, and the BC and Canada laws of nomination.
¡I am all for a if you want to and a law abiding 18 year old individual to run if you feel like it, let the voter choose on election day (when they have to show
¡proof) not leave it to 25 people here and there to decide nomination. People should run to be willing to take the office even with first day resignation.
¡The bylaw if they wanted it that way should have said, Mayor and Council or All Elected Offices; yet again not mine or any potential candidate's fault.
¡I ask the the Provincial Government to do the right thing and force them to go by the limitations of the language there-in.
¡I studied this whole document. I would have given a Mayor veto power and the option to pick his deputy separate of the council.
¡Even the constitutional thing and place no demands on nominees other than having to take the position and possibly make political
¡statements under oath in or running for office. I look forward to fight this crap for the future of council but I can't in legal terms in time,
¡I'd have to be able to put off the election until it's sorted out.
¡I think this is a case of someone not willing to admit they were wrong and made a mistake. They should admit that much and correct the mistake.
¡I am not going to run to be a "Member of Council" but "President of Council."
¡If I miss my shot, I will expect to make a human rights complaint. All incumbents and their party's, those supporting Bill 7, City Clerks Election Officials with all candidates also interested, may anyway for having to do this and voters who have to sign my or anyone's paper who have issues with doing so and for having bills and bylaws against their will without informed consent, who ran on this issue promising to support Bill 7 or the ByLaw or against with an all inclusive debate on it and other issues? I never saw election material with it on?
¡Time is money and I think signature collection costs more than the 100 dollar fee. Even at 10 dollar a collected signature (like federally) it would be valued at 250 bucks.
¡The "volunteering" is your time in office, not to seek to seek office. I find this attack on my liberty and this presumption that I am wasting voter time emotionally damaging (especially when sprung on the last minute). I waste it more asking for the signature but it's your (the establishment politician's) fault not mine.
¡More:
¡Mayor and Council(or) are separate in all language, hence the 'and.'
¡Mayor is legally defined as: Status of Mayor - 207. (1) The Mayor shall be the chief executive officer of the city and the president of the Council.
¡(2) Notwithstanding any other provision of this Act, the Council may, from time to time, with the concurrence of the Mayor, appoint a Councillor to be Deputy Mayor of the city, and may confer upon him such of the powers and duties by this Act vested in the Mayor as the Council shall think fit.

¡"election" means an election for Mayor or an election for the number of persons required to fill the office of Councillor;
¡9. (1) Elections for the Mayor and all Councillors, to .....
¡Size and quorum of Council
¡137. (1) Except as established under subsection (2), by a temporary order under section 10 (6) (a) or by the effect of section 139 (2), the Council is to consist of a Mayor and 10 Councillors, and the quorum for the Council is 6 members.
¡(2) Subject to the limit that there must be at least 10 Councillors, the Council may, by by-law, change the number of Councillors, in which case the quorum for the Council is the lowest number of Council members that is a majority of the total Council size as established by the by-law.
¡(3) A by-law under subsection (2) must provide for an uninterrupted transition from the previous Council.
¡(4) A by-law under subsection (2) that would reduce the size of Council must not be adopted without the assent of the electors.
¡1993-54-62.
¡138. (1) Unless a by-law under subsection (2) applies, every member of Council must be elected from the city at large.
¡Notice the Member of Council Candidates are the ones listed to run at large, the Mayor is not. In fact it is very unrestricted, an oversite, but it is not my or
¡any potential Candidate to Stand's fault someone left out rules for Mayoral elections.
¡There's this:
¡Term of office for Mayor and Councillors
¡139. (1) The term of office for a Mayor elected at a general local election
¡(a) begins on the first Monday after December 1 following the election or when the person takes office in accordance with section 140 (4), whichever is later, and
¡(b) ends immediately before the first Monday after December 1 in the year of the next general local election or when the Mayor's successor takes office, whichever is later.
¡(2) The term of office for a Councillor elected at a general local election
¡(a) begins on the first Monday after December 1 following the election or when the person takes office in accordance with section 140 (4), whichever is later, and
¡(b) ends immediately before the first Monday after December 1 in the year of the next general local election or when a sufficient number of members of Council have taken office to make up a quorum, whichever is later.
¡1993-54-62.

¡Council consists (a seated session) refers to a Mayor and Councillor not the Mayor who is a member of councillors. This is a separated power
¡and not a house majority leader like a Prime Minister or Premier. It's the "President if Council."
¡The "Member of Council" is mentioned in the Election ByLaw 9070
¡"11. Amendments to Election By-law
¡April 7, 2008 (VanRIMS No. 08-1000-02)
¡MOVED by Councillor Ladner
¡A. THAT the Election By-law No. 9070 be amended to require that a nomination
¡for office as a member of Council be made by 25 qualified nominators;
¡FURTHER THAT Council authorize the Director of Legal Services to bring
¡forward the necessary amendments to the Election By-law, generally in
¡accordance with Part 1 of Appendix A of the Administrative Report
¡Amendments to Election By-law, dated April 7, 2008, for enactment by
¡Council.
¡B. THAT the Election By-law No. 9070 be amended to require the City Clerk to
¡make the following documents more open and accessible to the public by
¡posting them to the City's web site and making photocopies available to
¡citizens:
¡1) Nomination documents for Mayor, Councillors and Park Commissioners
¡(starting with the 2008 civic election documents), and
¡2) Campaign Financial Disclosure Statements for Mayor, Councillors and
¡Park Commissioners (starting with the 2008 civic election statements);
¡FURTHER THAT Council authorize the Director of Legal Services to bring
¡forward the necessary amendments to the Election By-law, generally in
¡accordance with Part 2 of Appendix A of the Administrative Report
¡Amendments to Election By-law, dated April 7, 2008, for enactment by
¡Council."
