Sen. Berger Cleans Up SB 2081

As you recall, SB 2081, now titled "NICS Reporting/Restoration" would
have required clerks of court to report to the National Instant Check
System anyone either committed to mental health facilities or remanded
to *outpatient* care. Based on Virginia's experience, more than 80,000
North Carolinians could have been barred from owning guns.

Congratulations! The massive number of e-mails and phone calls you
generated to the General Assembly succeeded, and SB 2081 was amended
in the North Carolina Senate such that only those outpatients
adjudicated to be dangerous would be reported to NICS. Moreover,
petitions for restoration of rights by those who complete treatment
would be subjected to more reasonable standards of evidence and would
likely not have their more private medical data revealed to the world.

In large measure, you can thank Senator PHIL BERGER (R-Guilford,
Rockingham , GRNC ****) for the effort. Not only did Sen. Berger lead
the charge, he ran no less than three amendments to clean up the bill
- amendments which also put anti-gun senators on the wrong side of gun
votes.

Thanks also go to Raleigh-area attorney ED GREEN and Charlotte-area
attorney THOMAS FAULK, who spent countless hours researching the legal
ramifications of the bill and potential alternatives.

STOP CELEBRATING: THE JOB'S NOT DONE

Don't you hate it when we do that?

While the bill passed the Senate in a format for which GRNC will
remain neutral, it now heads to the House. Given that GRNC defeated
two of the most powerful Democrats in the state - Attorney General Roy
Cooper and Senate Rules Chairman Tony Rand - we can expect more
trouble when it hits the House.

Keep up the good work, folks. It's working and, with your efforts, we
will pass a clean bill.
